Terms & Conditions
Last updated: September, 2026
Welcome to my online shop. These Terms & Conditions apply to all purchases made through this website.
By placing an order, you confirm that you have read and accepted these Terms & Conditions. Nothing in these Terms & Conditions affects your statutory consumer rights.
1. About the shop
This website is operated by:
Sabīne Černuho
Ventspils, Latvia
Email: sabine.cernuho@gmail.com
I create and sell original paintings and art prints through this website.
2. Artwork
Each original painting is a unique, handmade artwork. Small variations in colour, texture, brushwork and details are a natural part of the artistic process.
I make every effort to display my artwork and colours as accurately as possible. However, colours may appear slightly different depending on your screen, monitor and device settings.
Each original painting is a one-of-a-kind artwork unless otherwise stated in the product description.
Art prints are reproductions of my original artwork and are not the original paintings.
3. Prices
All prices are displayed next to the relevant product.
Prices and availability may change from time to time. Changes will not affect orders that have already been accepted.
Shipping costs, where applicable, will be shown before you complete your purchase.
4. Placing an order
To place an order, select the artwork you wish to purchase and complete the checkout process.
After placing your order, you will receive an order confirmation by email.
An order is considered accepted once payment has been successfully received, subject to any applicable statutory cancellation or withdrawal rights.
I reserve the right to cancel an order in exceptional circumstances, for example if an artwork is unexpectedly unavailable or if there has been an obvious pricing or technical error. If your order is cancelled, you will receive a full refund of any amount already paid.
5. Payment
Payment is made using the payment methods available at checkout.
Depending on the options available on the website, these may include PayPal, Stripe, Squarespace Payments and/or Google Pay.
Your payment information is processed by the relevant payment provider. I do not store your full payment card details.
6. Shipping and delivery
I carefully package each artwork to protect it during transportation.
Orders within Latvia
Original paintings shipped within Latvia will be sent stretched on a wooden frame and ready to hang, unless otherwise stated in the individual product description.
International orders
For international orders, original paintings will generally be shipped rolled in a sturdy protective cardboard tube rather than stretched on a frame.
This allows the artwork to be transported more safely and economically over longer distances.
Once received, the painting will need to be professionally stretched onto a suitable wooden frame before it can be displayed.
The cost of stretching and framing an internationally shipped original artwork after delivery is the responsibility of the buyer.
Art prints
Art prints may be shipped rolled in a protective cardboard tube, depending on their size and destination.
Specific shipping information for each product may be provided in the product description.
I aim to dispatch orders within 3-5 business days after payment has been received.
Estimated delivery times depend on the destination and the shipping provider.
If a specific delivery timeframe has been agreed for your order, that timeframe will apply. Where no delivery period has been agreed, applicable statutory delivery requirements will apply.
International orders may be subject to customs duties, import taxes or other charges imposed by the destination country. Unless explicitly stated otherwise, these charges are the responsibility of the buyer.
7. Internationally shipped paintings and stretching
When an original painting is shipped internationally rolled in a tube, the artwork should be handled carefully and, where necessary, allowed to relax before being stretched.
I strongly recommend having the artwork stretched by a professional framer or art conservator experienced in handling canvas paintings.
I am not responsible for damage caused by improper handling, storage, stretching, framing or mounting after the artwork has been delivered.
This does not affect your statutory rights in relation to damage or defects that existed before delivery.
8. Damaged or lost packages
I take care to package every artwork securely before dispatch.
If your package arrives visibly damaged, please photograph the packaging and artwork as soon as possible and contact me at sabine.cernuho@gmail.com.
If an artwork arrives damaged, please provide photographs of the artwork and packaging so that I can investigate the issue with the delivery provider and arrange an appropriate solution.
Your statutory consumer rights are not affected by this procedure.
9. Right of withdrawal
If you are a consumer purchasing from within the European Union, you generally have the right to withdraw from a distance purchase within 14 days from receiving the artwork, without having to provide a reason.
To exercise your right of withdrawal, please contact me at:
You must communicate your decision to withdraw before the withdrawal period expires.
After notifying me of your decision to withdraw, you must return the artwork within 14 days.
The artwork should be returned safely packaged and in a condition that allows it to be resold.
You are responsible for the direct cost of returning the artwork unless otherwise required by applicable law or agreed with me in advance.
I will refund the payment received from you, including the standard delivery cost paid for the original shipment, in accordance with applicable law. I may withhold the refund until I have received the returned artwork or you have provided evidence that it has been sent back.
You may be responsible for any diminished value resulting from handling the artwork beyond what is necessary to establish its nature, characteristics and functioning.
10. Exceptions to the right of withdrawal
The statutory right of withdrawal does not apply in certain circumstances provided by law, including where an artwork has been made according to the customer's specifications or is clearly personalised.
If an artwork is specifically commissioned or personalised for you, the applicable withdrawal rights will be explained before the order is accepted.
11. Faulty, damaged or non-conforming artwork
If an artwork is faulty, damaged or does not conform to the contract, please contact me at sabine.cernuho@gmail.com and describe the issue.
I will assess the issue and provide a remedy in accordance with applicable consumer protection legislation.
Nothing in these Terms & Conditions limits your statutory consumer rights.
12. Returns
If you wish to return an artwork under your statutory right of withdrawal, please contact me before sending it back.
The artwork must be packaged appropriately to prevent damage during return transportation.
Unless otherwise required by applicable law, the direct cost of returning an unwanted item is the responsibility of the buyer.
13. Intellectual property
All artwork, photographs, images, text and other creative content on this website are my intellectual property or are used with permission.
Purchasing an artwork does not transfer copyright or reproduction rights to the buyer.
You may display the artwork for personal purposes, but you may not reproduce, scan, copy, distribute, resell or commercially use the artwork or its image without my prior written permission.
Copyright remains with the artist unless expressly agreed otherwise in writing.
14. Website content
I make reasonable efforts to ensure that the information on this website is accurate and up to date.
However, photographs and digital displays cannot always reproduce the exact colours, textures and appearance of a physical artwork.
Minor differences between the artwork shown on the website and the physical artwork may therefore occur.
15. Limitation of liability
Nothing in these Terms & Conditions excludes or limits any liability that cannot legally be excluded or limited under applicable law.
I am not responsible for delays caused by circumstances outside my reasonable control, including delays caused by shipping providers, customs authorities, natural events or other circumstances beyond my control.
16. Privacy
Personal information collected when you place an order or contact me is handled in accordance with my Privacy Policy.
17. Governing law and consumer rights
These Terms & Conditions are governed by the laws applicable in Latvia, without limiting any mandatory consumer protection rights that may apply to consumers in their country of residence.
Nothing in these Terms & Conditions is intended to restrict rights granted to consumers by applicable law.
18. Contact
